GENERAL CONDITIONS OF PURCHASE
These General Conditions of Contract (hereinafter, General Conditions) regulate the process of buying and selling the products offered by VIÑEDOS Y BODEGAS ALCONDE S.L. in the catalogue available on its website www.bodegasalconde.com.
The General Conditions bind VIÑEDOS Y BODEGAS ALCONDE SL. and the buyer (Customer), granting them a series of rights and obligations, from the moment the latter places and accepts an order through this page. They are of obligatory compliance and knowledge by both parties, so their acceptance is essential to be able to formalize an order. Therefore, the Client must read these conditions carefully.
The headings of the different clauses are for information purposes only, and shall not affect, qualify or extend the interpretation of the General Conditions.
These General Terms and Conditions shall be governed by the provisions of the legal regulations in force.
The sale of alcoholic beverages to persons under 18 years of age is prohibited, therefore, VIÑEDOS Y BODEGAS ALCONDE SL. will not register or supply anyone under the legally permitted age.

For any communication that may be required between VIÑEDOS Y BODEGAS ALCONDE SL. and the Client, the latter should contact the Customer Service Department by e-mail by sending a message to firstname.lastname@example.org or by post by sending a letter addressed to the Customer Service Department of Bodegas Alconde to the postal address indicated above.
Any User of the website www.bodegasalconde.com who places an order and accepts it at the time of placing it shall be considered a Customer.
The Customer must register as such and provide the following data in order to place the order: name and surname or company name, VAT number, invoice address, delivery address, contact telephone number and contact email address.
OBJECT OF THE CONTRACT
The object of this contract is the purchase and sale of alcoholic beverages belonging to the VIÑEDOS Y BODEGAS ALCONDE SL. wineries on this website.
Each product has a file with a description of the product and its selling price including VAT.
The final purchase price of a product or its shipping costs may vary depending on the region of destination or the method of payment, since depending on the geographical area where it is sent, the costs may vary and depending on the method of payment, you can access a series of discounts or not. In any case, as the customer indicates the delivery address and the method of payment, the page will offer the exact price of the products.
In most cases, the product file will contain a photograph of the product, as well as its technical characteristics, which have been obtained from the manufacturer itself or, failing that, from other publicly available sources.
On the other hand, sales made by natural or legal persons domiciled in any of the EU countries will be subject to VAT.
The minimum order is six bottles.
BODEGAS ALCONDE informs that its website is exclusively for sales on the Spanish mainland. For sales outside this territory, please contact the selling company.
ACCEPTANCE OF THE OFFER
This occurs at the moment in which the Customer gives his express consent to the order placed, and after acceptance of the General Conditions. It is materialised by accepting these and clicking on the “CONFIRM ORDER” button on the order placement screen.
At the moment of activating the order, the customer formalises a product purchase contract with VIÑEDOS Y BODEGAS ALCONDE SL, acquiring the rights and commitments established in the applicable regulations and those set out in these general contracting conditions.
After accepting the order, VIÑEDOS Y BODEGAS ALCONDE S.L. will contact the customer within a maximum period of 48 hours to confirm the order.
The invoice issued for the purchase will be sent with the products purchased.
PAYMENT OF ORDERS
The fact that the order is placed does not mean that the product/s are reserved; the product/s will be reserved at the moment the payment is made.
In the event that the product is not in stock at that time, we will contact you to inform you of the situation and inform you of the next availability of the product or, where appropriate, to proceed to the cancellation of the order and the corresponding refund of the amount.
VIÑEDOS Y BODEGAS ALCONDE SL, offers the customer different methods of payment, among which you can find:
Payment by visa/master card/maestro/euro 6000/american express card.
VIÑEDOS Y BODEGAS ALCONDE S.L. can increase or reduce the number of payment methods at any time.
The customer will select the payment method chosen from those available at the time of purchase.
1. Payment by credit card:
The customer may choose to pay by credit card, the operation being carried out at the time of placing the order. Only visa/master card/maestro/euro 6000/american express cards are accepted.
The system will automatically calculate the shipping costs associated with the method of payment chosen by the Client, and these total prices will be communicated prior to the acceptance of the order by the Client.
You must notify BODEGAS ALCONDE of any undue or fraudulent charge on the card used for the purchase, by email or telephone, as soon as possible, so that BODEGAS ALCONDE can take the appropriate steps.
DELIVERY TIMES FOR ORDERS
The delivery times of orders depend on the availability of the product or products that compose them. The maximum delivery time in the Peninsula is 5 working days and 7 working days for deliveries to territories outside the Peninsula, once payment has been confirmed. These delivery times may be subject to change during holiday periods or due to circumstances beyond VIÑEDOS Y BODEGAS ALCONDE S.L. control.
For deliveries to territories outside the Peninsula, please consult with the Customer Service Department prior to purchase.
Under no circumstances will deliveries be made to post office boxes.
However, the delay in delivery will not imply any compensation and will only entitle the Customer to cancel the order when the circumstances described in the following point of these conditions occur. Any penalty clause for delay introduced by the Customer in his order shall be null and void.
VIÑEDOS Y BODEGAS ALCONDE S.L. will try to provide as much information as possible on the availability of the products in each order placed.
Deliveries will be made by a courier company to the delivery address indicated in the delivery details of the order. Subsequent modification of this address may generate a series of expenses that will be charged to the Customer and delivery may be affected.
WITHDRAWAL / CANCELLATIONS
The Customer has the right to cancel the order within seven working days of receipt of the order, as stated in Article 44 of Law 7/1996, of 15 January, on the Regulation of Retail Trade.
To do so, you must inform VIÑEDOS Y BODEGAS ALCONDE S.L., filling in the withdrawal or revocation document that accompanies the delivery note, so that there is a record of the withdrawal and sending it by post to the Customer Service Department of VIÑEDOS Y BODEGAS ALCONDE S.L. at the address CTRA ESTELLA, 60 – 31260 – LERIN (NAVARRA).
Once the withdrawal communication has been made, VIÑEDOS Y BODEGAS ALCONDE S.L. will reply to the request indicating how to return the product. This return will be made within 7 days from the communication to VIÑEDOS Y BODEGAS ALCONDE S.L. of the return procedure. The costs incurred will be borne by the Customer. The withdrawal form and a copy of the delivery note or invoice will be sent together with the product.
When the Customer has exercised the right of withdrawal or cancellation, VIÑEDOS Y BODEGAS ALCONDE S.L. will be obliged to return the sums paid by the Customer. The refund of these sums will be made as soon as possible and, in any case, respecting the legally stipulated period.
If at the time of delivery, without the need to manipulate the shipping packaging or the product itself, it is visibly and clearly seen that a product has defects caused by damage in transport or, in the same way, an error is seen in the product received, the withdrawal form accompanying the delivery note must be filled in and sent by post to VIÑEDOS Y BODEGAS ALCONDE S.L. at the address indicated above. In this case, VIÑEDOS Y BODEGAS ALCONDE S.L. will deliver to the user another product equal to the one purchased, collecting the defective one when delivering the new product, VIÑEDOS Y BODEGAS ALCONDE S.L. assuming the costs of this management. In the event that the Customer has chosen to return the money, he/she must indicate on the withdrawal form the holder and the account number to which he/she wants the corresponding amount to be paid. The refund will be made within the legally stipulated time.
The right of withdrawal may not be exercised in the event that the product is not returned in its original packaging and when the product is not in perfect condition. Rights of withdrawal outside the stipulated period will not be honoured either.
The legal framework of guarantee (Law 23/2003, of 10 July, on guarantees in the Sale of Consumer Goods) aims to provide the Customer with different options for claiming compensation when the goods purchased do not conform to the contract, giving the Customer the option of demanding the repair or replacement of the goods, unless this is impossible or disproportionate.
By virtue of this, VIÑEDOS Y BODEGAS ALCONDE S.L. shall be liable to the Client for any lack of conformity existing at the time of delivery of the products of the order, these being understood as tangible goods intended for private consumption.
The delivery note stamped by BVIÑEDOS Y BODEGAS ALCONDE S.L. is valid as a guarantee and must be handed over together with the original of the accompanying return form in the event of claims for possible incidents (damaged or wrong product or any other cause for complaint).
For all aspects of the commercial guarantee referred to in Article 11 of Law 23/2003, of 10 July, on guarantees in the Sale of Consumer Goods, the contents of Law 7/1996, of 15 January, on the Regulation of Retail Trade, shall be applicable.
In accordance with art. 1 of RD 5/1997 14 January, there are complaint forms available to our customers at the company’s offices.

OBLIGATIONS OF VIÑEDOS Y BODEGAS ALCONDE S.L.
In the event that it is possible to deliver the ordered goods in the conditions agreed with the customer, to deliver the product in good condition at the agreed place of delivery.
To respect the price of the orders agreed at the time of placing them.
RIGHTS OF THE CUSTOMER
In case of receiving the products, that these are received in the agreed conditions and that they are in perfect condition.
The immediate refund of any amount paid in advance to the company in the event that the company is unable to deliver the products in the agreed conditions.
To cancel the order in the cases established in these General Conditions.
RIGHTS OF VIÑEDOS Y BODEGAS ALCONDE S.L.
To receive payment for orders.
To modify the prices established on its website for its products.
Modify the delivery times of the product depending on the availability of the same.
Cancel orders due to non-payment by the Client.
Cancel the website without prior notice.
For the purposes of notifications, requirements and writings of any kind to which this contract gives rise, the address of VIÑEDOS Y BODEGAS ALCONDE S.L. will be understood to be that indicated in these General Conditions.
VALIDITY OF THE CLAUSES
Even if a clause of this contract or one of its parts is declared invalid or unenforceable, the rest of the clauses or its parts will continue to be valid and valid.
These General Conditions are governed by the Spanish legislation in force, and specifically by: Civil Code, Law 26/84 of 19 June 1984 on the General Law for the Defence of Consumers and Users, Law 7/98 of 13 April 1998 on General Contracting Conditions, Law 7/96 of 15 January 1996 on the Regulation of Retail Trade, Directive 2000/31 EC of the European Parliament and of the Council of 8 June, Law 34/2002 of 11 July 2002 on Information Society Services and Electronic Commerce, Law 23/2003 of 10 July 2003 on Guarantees in the Sale of Consumer Goods and the regulations that develop them.
